1. Acceptance of Terms

By accessing or using Bizmorph ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms apply to all individuals and businesses ("Users") who access Bizmorph.

You must be at least 18 years of age to use Bizmorph. By using the Service, you represent that you meet this requirement.

2. Description of Service

Bizmorph is a SaaS platform that allows users to create, configure, and deploy AI-powered customer support chatbots on their websites. The Service includes:

• Bot creation and configuration tools
• An embeddable chat widget
• AI response generation via third-party providers (OpenAI)
• Lead capture and management
• A user dashboard for managing bots, leads, and account settings

3. Accounts and Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Bizmorph to:

• Violate any applicable Indian or international law or regulation
• Distribute spam, malware, or harmful content via the widget
• Impersonate any person or entity
• Collect data from minors without appropriate consent
• Use the Service for illegal, deceptive, or fraudulent purposes
• Attempt to reverse-engineer, scrape, or exploit the platform's infrastructure
• Circumvent usage limits or access controls

We reserve the right to remove any content or suspend any account we deem to be in violation of these rules, without prior notice.

5. AI Responses — Disclaimer

AI-generated responses may be inaccurate, incomplete, or inappropriate. Bizmorph does not guarantee the accuracy of any responses produced by the AI assistant. Users are solely responsible for reviewing and validating the information their bots provide to end users.

You acknowledge that Bizmorph's AI is powered by third-party providers (including OpenAI) and that their respective terms and usage policies also apply.

6. Payments and Billing

Bizmorph offers paid subscription plans. Payments are processed securely via Lemon Squeezy. By subscribing to a paid plan, you authorise Bizmorph to charge the applicable fees to your payment method on a recurring basis.

• All prices are listed in US Dollars (USD). Final charges may vary in Indian Rupees (INR) based on current exchange rates and applicable taxes such as IGST.
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are offered at our discretion and are evaluated on a case-by-case basis
• We reserve the right to change pricing with 30 days' notice

7. Usage Limits

Each plan has a monthly request limit. Once a limit is reached, the AI assistant will notify end users and direct them to alternative contact methods. Limits reset on the first day of each calendar month. We reserve the right to enforce fair use policies to maintain platform stability.

8. Intellectual Property

All platform code, design, branding, and associated intellectual property are owned by Bizmorph. You retain ownership of your business content and knowledge base data. By uploading content, you grant Bizmorph a limited, non-exclusive licence to use that content solely to provide the Service.

9. Service Availability and Changes

We strive for high uptime but do not guarantee uninterrupted access to the Service. Bizmorph may be modified, updated, or discontinued at any time, with or without notice. We are not liable for any loss resulting from service interruptions or changes.

10. Termination

You may terminate your account at any time from your dashboard settings. We may terminate or suspend your account at our discretion if we determine you have violated these Terms. Upon termination, your data may be deleted within 30 days.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Bizmorph shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of India.
